Are all these skins allowed to be used by players who do not own them under the new TOS introduced by FP on the 7th August ? , Do users risk banning by FP and server blacklisting if any of these are used ?

tbh ill put it this way- Facepunch is a developer of Rust- utilizing the Steam platform to distribute their game. The skins they upload each week from players who create them, or throughout the community like twitch. The people who create the skins get a specific percentage of payment for their contribution, facepunch marks this up to sell as cosmetic items (mtx or microtransactional) , and publishs the workshop items FOR FREE prior to making them paid.

Essentially Steam (Platform) Facepunch (Developer) Rust (Game) Skins (Community made). They cannot do anything related to skins (other than maybe update and be like yeah we will _eventually_ ban players for using skins non paid)  as they would be violating Steams TOS on this. So its a catch-22. yeah they can do xyz, but the xyz can be reversed.

This is a twitch drop item (supposedly non obtainable oooo) , you can download the bitmap and pngs directly from steamcmd.

So yes  any player- regardless of who - can utilize skins for free as theyre workshop uploaded and driven.

Also , regarding your server question, 

You can play private servers with skins for free- thats no violation. You can host a server with skins to the players, granted,  YOU are the host, if hosting a server ensure steam auth, eac auth, encryption are disabled.
Now im not sure what theyre going to entirely do with the new patch, but all they'd be doing is hurting the player base by forcing micro transactional cosmetic items.

Felt. enjoy using the skins! i recommend you use the official (1100 skins approx 118.56mb) and the full skion list contains 68k approx lol gotta love the rust devs making the game not pve, nor pvp, but mvp (most valuable player)
